I. General Terms and Conditions
§ 1. Basic Provisions
These Terms govern contracts you conclude with us as the seller (EnduraBoost) via our online store https://enduraboost.de/. Unless expressly agreed otherwise, we object to the inclusion of any terms and conditions that differ from or conflict with these Terms.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in exercise of their trade or profession.
§ 2. Conclusion of the Contract
The subject of the contract is the sale of goods.
The presentation of products on our Website does not constitute a legally binding offer, but a non-binding invitation for you to submit an order. By placing an order, you make a binding offer to purchase the selected goods. The contract is concluded only when we expressly accept your order or dispatch the goods.
The contract via the online cart system is concluded as follows:
Items intended for purchase are placed in the shopping cart; you can view and edit the cart at any time.
After clicking “Checkout” / “Proceed to purchase” and entering personal, payment, and shipping details, you will see an order overview.
If you use instant payment methods (e.g., PayPal, Apple Pay, Google Pay), you may be redirected to the provider’s page to enter/confirm details and then back to our order overview.
Before submitting the order, you can review and change the information (including via your browser’s “back” function) or cancel the process.
By clicking “Buy now” / “Pay now” / “Place order” (or similar), you submit a binding offer.
Your requests for a bespoke quote are non-binding. We will send a binding offer in text form (e.g., by email) that you can accept within 5 days, unless another period is stated.
Order processing and the transmission of all information required for contract performance take place by email, partly automated. You must ensure the email address you provide is correct and that our messages can be received (not blocked by spam filters).
§ 3. Payment Methods
We accept the following payment methods:

Payment cards (Visa, Mastercard, etc.) via a certified payment processor;

Apple Pay / Google Pay (where supported by your device/browser and issuing bank);

PayPal (where available in your country).
The availability of specific methods may vary by country, currency, and anti-fraud checks at checkout. Unless stated otherwise, charges are captured at the time of ordering.
Payment security. Payments are processed by third-party providers; we do not store full card details. Providers may perform additional checks (e.g., 3-D Secure) and may temporarily hold or cancel transactions on suspicion of fraud.
We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases of suspected fraud, unauthorized payment, pricing errors, technical errors, or violations of these Terms. If payment has already been made, the amount will be refunded using the original payment method.
§ 4. Right of Retention; Reservation of Title
You may exercise a right of retention only in respect of claims arising from the same contractual relationship.
Goods remain our property until the purchase price has been paid in full.
§ 5. Warranty (Liability for Defects)
Statutory warranty rights apply.
Consumers are requested to inspect the goods promptly upon delivery for completeness, obvious defects, and transport damage, and to notify us and the carrier as soon as possible. Failure to do so does not affect your statutory warranty rights.
Where a feature of the goods deviates from objective requirements, such deviation is deemed agreed only if you were informed before ordering and the deviation was expressly and separately agreed between the parties.
To the extent permitted by applicable law, we shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of data, or business interruption arising out of or related to the use of our products.
Our total liability under any contract shall be limited to the amount paid by you for the respective order.
Nothing in these Terms shall limit liability for intent, gross negligence, personal injury, or liability under mandatory statutory provisions.
§ 6. Choice of Law
German law applies. For consumers, this choice of law applies only insofar as it does not deprive you of protection granted by mandatory provisions of the law of the country in which you have your habitual residence.
If you are a merchant, the exclusive place of jurisdiction shall be Warsaw, Poland.
The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) do not apply.

We are not willing or obliged to participate in dispute resolution proceedings before consumer arbitration boards.
2. How the Contract Is Concluded
The technical steps for concluding the contract, the conclusion itself, and options for correcting input errors are set out in “§ 2. Conclusion of the Contract” above.
3. Contract Language; Storage of Contract Text
3.1. The contract language is English (other language versions may be provided for convenience; in case of discrepancies, the English version prevails).
3.2. We do not store the complete contract text. Before submitting the order via the online cart system, you can print or save the contract data using your browser’s print function. After we receive your order, we will email you the order data, the legally required distance-selling information, and these Terms.
3.3. For bespoke offers outside the online cart system, you will receive all contract data as part of a binding offer by email, which you can print or save electronically.
4. Essential Characteristics of Goods/Services
The essential characteristics of the goods/services are shown in the respective product listing.
5. Prices and Payment
5.1. Prices shown in listings and shipping costs are total prices, including all applicable taxes.
5.2. Shipping costs are not included in the product price; they are shown separately during checkout and are payable by you unless free shipping is offered.
5.3. Any bank transfer or exchange-rate fees charged by financial institutions are borne by you if delivery is to an EU member state but payment is initiated outside the European Union.
5.4. Available payment methods are displayed on the Website and/or during checkout (see § 3).
5.5. Unless otherwise specified for a given method, payment claims arising from the contract are due immediately.
6. Delivery Conditions
6.1. Delivery conditions, lead times, and any delivery restrictions are shown on the Website and/or in the relevant offer.
6.2. If you are a consumer, the risk of accidental loss or deterioration of the goods during shipment passes to you only upon delivery, regardless of whether shipment is insured. This does not apply if you independently commission a carrier not designated by us.

Warranty is governed by § 5 of these Terms.
